Terms of Use

1. Acceptance of Terms

Welcome to Quilloom ("the Platform," "we," "us," or "our"). By creating an account, accessing, or using our interactive storytelling platform, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms form a legally binding agreement between you ("User," "you") and the Platform administrator.

2. Description of Service

Quilloom is an interactive storytelling platform that allows users to create, read, and share AI-generated stories. The Platform provides tools for character development, story planning, journaling, audio narration, background customization, a marketplace for selling completed stories, social features (following authors, commenting), and a gamification system (points and badges). The Platform also offers subscription plans and one-time purchases to enhance the storytelling experience.

3. User Accounts

You must provide accurate and complete information when creating an account. You are solely responsible for maintaining the security of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, pose a risk to the Platform or other users.

4. User-Generated Content

You retain ownership of the intellectual property in the stories, journal entries, character profiles, comments, and other content you create on the Platform ("User Content"). By submitting User Content, you grant the Platform a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, use, display, reproduce, modify, adapt, publish, and distribute your User Content solely for the purpose of operating, promoting, and improving the Platform's services.

You represent and warrant that your User Content:

• Does not violate any law or third-party rights
• Does not contain infringing, defamatory, or harmful material
• Does not contain content involving minors in sexual situations
• Does not promote illegal activity, violence, hate, or harm
• Complies with the Platform's Story Safety & Ethics Framework

We reserve the right to remove, moderate, or restrict any User Content that we believe violates these Terms or is otherwise harmful, without notice and at our sole discretion.

5. AI-Generated Content

Stories generated through the Platform are created by artificial intelligence based on your inputs and choices. AI-generated content may contain errors, inconsistencies, or unexpected results. We do not guarantee the quality, accuracy, or appropriateness of any AI-generated content. You are responsible for reviewing all content before publishing or sharing it. The Platform is not liable for any consequences arising from AI-generated content.

6. Content Protection

Story content displayed on the Platform is protected by copyright and may not be copied, pasted, downloaded, screenshotted, redistributed, or otherwise reproduced without authorization. Copying and pasting of story text is disabled. To obtain a downloadable copy of a completed story, users must purchase the Story Export feature. Unauthorized reproduction, distribution, or use of content from the Platform is a violation of these Terms and may constitute copyright infringement.

7. Marketplace and Story Sales

Users may list completed stories for sale on the Platform's marketplace. The following terms apply:

• Only completed stories may be listed for sale
• Authors may choose flat-rate pricing or subscription-based access
• Authors may offer a limited number of free chapters as a preview
• The Platform retains a 5% service fee on all story sales, with 95% of the sale price going to the author
• Authors are responsible for any tax obligations related to their earnings
• The Platform reserves the right to remove any listing at its sole discretion

Authors set their own prices, subject to a minimum of $0.50 per transaction. Payment processing is handled by Base44 Payments (powered by Wix). Payout schedules and methods are determined at the Platform's discretion.

8. Subscriptions and Payments

The Platform offers subscription plans (Plus and Pro) and one-time purchases. All payments are processed securely by Base44 Payments. Subscription fees are billed monthly and will automatically renew until cancelled. You may cancel your subscription at any time. Refunds are issued at the Platform's sole discretion. Prices and features of subscription plans may change at any time with notice.

9. Points and Badges

The Platform awards points and badges for engagement activities such as completing chapters, writing journal entries, and finishing stories. Points and badges have no real-world monetary value and cannot be redeemed for cash or other benefits unless explicitly stated by the Platform. The Platform reserves the right to modify, revoke, or reset points and badges at any time without notice.

10. Prohibited Conduct

You agree not to:

• Copy, scrape, or extract content from the Platform through automated or manual means
• Attempt to bypass copy protection, paywalls, or access restrictions
• Share account credentials or allow others to access your account
• Use the Platform for any illegal or unauthorized purpose
• Harass, stalk, or harm other users
• Submit content that violates the Story Safety & Ethics Framework
• Manipulate the points or badge system
• Reproduce or distribute stories without purchasing export rights
• Interfere with the Platform's operation, security, or integrity

11. Content Oversight & Monitoring

The Platform actively monitors user-generated content to ensure compliance with these Terms. Oversight is conducted through the following mechanisms:

• Protector Agent: An automated AI-powered content moderation system ("Protector") continuously scans all user stories — including premises, chapter content, chapter summaries, and sale descriptions — as well as all comments and ratings (whether approved or pending author review) for potential Terms of Use violations.
• Automated Scanning: Content is analyzed in batches using AI to detect prohibited material, including but not limited to content involving minors in sexual situations, illegal activity, hate speech, harassment, defamatory material, and attempts to bypass copy protection or paywalls.
• Violation Reports: When potential violations are detected, a detailed report is generated and sent to the Platform administrator. Each report includes: who (user identity), what (the specific violating content), when (date and time of creation), where (where the content appears on the Platform), why (the reason it violates the Terms), which (the specific Term violated), and how (how the violation was detected).
• Manual Review: The Platform administrator may also manually review content flagged by user reports, automated systems, or during routine audits.
• User Reporting: Users are encouraged to report content they believe violates these Terms. All reports are reviewed by the Platform administrator.

This oversight applies to all content on the Platform, regardless of whether it is public, private, listed for sale, or pending approval. No content is exempt from monitoring.

12. Investigation & Enforcement Process

No enforcement action will be taken against any user until a thorough investigation has been conducted and a judgment has been made regarding the user's actions or behavior. The enforcement process follows these steps:

• 1. Detection: A potential violation is identified through automated scanning (Protector Agent), user reports, or manual review.
• 2. Investigation: The Platform administrator conducts a thorough investigation of the flagged content, reviewing the specific content in question, the context in which it was created, the user's account history, and any relevant patterns of behavior.
• 3. Judgment: After investigating, the Platform administrator makes a determination as to whether a Terms of Use violation has occurred. This judgment considers the nature and severity of the content, the user's intent, and whether the violation is repeated.
• 4. Enforcement: If a violation is confirmed, enforcement actions are applied as described in Section 13. No action is taken until the investigation is complete and a judgment has been rendered.
• 5. Notification: The user will be notified of the judgment and any enforcement actions taken against their account or content.

The Platform reserves the right to expedite the investigation process and take immediate interim measures (such as temporarily hiding content) in cases involving critical violations, including content involving minors in sexual situations, illegal activity, or imminent harm. A full investigation and judgment will still be conducted before any permanent enforcement action is applied.

13. Consequences of Violations

If, after investigation and judgment, a user is found to have violated these Terms of Use, the following consequences may be applied at the Platform administrator's sole discretion, depending on the nature and severity of the violation:

• Story Removal: The violating story or stories will be removed from the Platform. The user will permanently lose access to the removed story or stories, including all associated content such as chapters, journal entries, character profiles, and sale listings. Removed stories cannot be recovered. This consequence applies to the specific story or stories found to be in violation.
• Account Removal: The user's account will be permanently terminated. The user will no longer be able to access their account, and they will lose access to all stories, journal entries, points, badges, purchases, followers, and any other content or data associated with their account. Account removal is permanent and cannot be reversed. The user will not be permitted to create a new account on the Platform.

Factors considered when determining the appropriate consequence include:

• The severity of the violation (critical violations such as content involving minors will result in immediate account removal)
• Whether the violation is a first offense or a repeat offense
• The user's account history and prior conduct
• The scope and impact of the violating content
• Whether the user demonstrated intent to violate the Terms

The Platform administrator reserves the right to apply either consequence, or both, at their sole discretion. Story removal may be applied as a standalone consequence for less severe or first-time violations. Account removal is reserved for severe, repeated, or critical violations. No refunds will be issued for removed stories or terminated accounts.

14. Intellectual Property

The Platform, including its design, features, code, background imagery, mood themes, user interface, and all associated intellectual property, is owned by the Platform administrator and protected by copyright, trademark, and other laws. User Content is owned by the respective users subject to the license granted in Section 4. AI-generated story content is owned by the user who initiated its creation, subject to these Terms.

15. Third-Party Services

The Platform integrates with third-party services including AI providers, Base44 Payments (Wix), and email delivery services. We are not responsible for the actions, availability, or policies of these third parties. Your use of third-party services is subject to their respective terms and privacy policies.

16. Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, secure, or that AI-generated content will meet your expectations. Your use of the Platform is at your sole risk. To the maximum extent permitted by law, we disclaim all warranties.

17. Limitation of Liability

To the maximum extent permitted by law, the Platform administrator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or content, arising from your use of or inability to use the Platform, including the removal of stories or termination of accounts under the enforcement provisions of these Terms. Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you have paid to the Platform in the preceding twelve (12) months.

18. Indemnification

You agree to indemnify, defend, and hold harmless the Platform administrator and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from your User Content, your violation of these Terms, your misuse of the Platform, or your infringement of any third-party rights.

19. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without cause or notice, including through the enforcement process described in Sections 11 through 13. Upon termination, your right to use the Platform ceases immediately. You may stop using the Platform at any time. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 4, 6, 13, 14, 16, 17, and 18.

20. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on the Platform. Your continued use of the Platform after any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Platform administrator operates, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.
